# Garden suites in Toronto: can I build one on my lot?

Toronto permits one garden suite on eligible residential lots, subject to Zoning By-law 569-2013 and other applicable law. You do not need a laneway.

Your zone, yard dimensions, setbacks, building separation, tree protection and emergency access decide whether a design can proceed to a building permit. An address check starts that assessment; it does not approve construction.

## Which Toronto lots can have a garden suite?

A garden suite is a separate home in an ancillary building that does not abut a lane. A laneway suite follows Section 150.8 instead. A lot cannot contain both. Garden-suite permissions cover the R, RD, RS, RT and RM residential zones, subject to their conditions.

For an R-zoned lot, 10.10.20.20(1) lists Garden Suite as a use with conditions; 10.10.20.100(20) sends it to Section 150.7. Check the mapped zone, site-specific exceptions and any former municipal by-law that still applies.

## Lot conditions that change the answer

Area alone does not establish that a suite fits. Measure the actual frontage, available rear yard and existing buildings. The table summarises new construction; corner lots, through lots and lawful existing buildings have additional provisions.

Toronto garden-suite checks. Read each linked provision with its exceptions.

| Condition | What to check | Governing provision |
| --- | --- | --- |
| Frontage and landscaping | Soft landscaping in the defined rear-yard area: 50% for frontage over 6 m; 25% otherwise. The 6 m breakpoint is not a minimum frontage. | [150.7.50.10(1)](https://www.toronto.ca/zoning/bylaw_amendments/ZBL_NewProvision_Chapter150_7.htm) |
| Side setbacks | With side openings away from a street: greater of 1.5 m or 10% of frontage, capped at 3 m. Otherwise: greater of 0.6 m or 10%, capped at 3 m. Corner-lot rules differ. | [150.7.60.20(5)–(6)](https://www.toronto.ca/zoning/bylaw_amendments/ZBL_NewProvision_Chapter150_7.htm) |
| Rear setback | Normally 1.5 m. Lots deeper than 45 m, upper rear openings beside residential lots and through lots need separate checks. | [150.7.60.20(2)–(4)](https://www.toronto.ca/zoning/bylaw_amendments/ZBL_NewProvision_Chapter150_7.htm) |
| Separation and height | Generally 4 m separation for a suite no higher than 4 m; 7.5 m separation for a taller suite, up to 6.3 m. The defined east-end area has a separation exception. | [150.7.60.30(1), 150.7.60.40(1)](https://www.toronto.ca/legdocs/bylaws/2025/law0849.pdf) |
| Floor area | Maximum gross floor area: 60 m² for one storey, 120 m² otherwise, and less than the residential building. Garden-suite floor area is excluded from lot FSI. | [150.7.60.50(1), (2), (4)–(5)](https://www.toronto.ca/zoning/bylaw_amendments/ZBL_NewProvision_Chapter150_7.htm) |
| Lot coverage | For a non-apartment residential building: either 45% total coverage, or the 20% combined ancillary-building branch with the main-building coverage overlay. Apartment buildings use a separate provision. | [150.7.60.70(1)–(2)](https://www.toronto.ca/legdocs/bylaws/2025/law0849.pdf) |

## When provincial rules change the zoning check

Toronto says Ontario Regulation 462/24 affects qualifying additional residential units where the result is no more than three units on the lot. It does not apply to a triplex plus a new garden suite. Read it together with the municipal by-law.

The City describes changes to separation, lot coverage, FSI and minimum lot area. Minimum frontage, building setbacks and maximum gross floor area still require the zoning check. The City’s guidance retains the relationship between height and separation; a provincial 4 m separation provision is not permission for a taller suite everywhere.

## Emergency access, trees and the building permit

Toronto’s fire-access guide requires a clear path at least 0.9 m wide for a sprinklered garden suite or 1.0 m for a non-sprinklered suite, and 2.1 m high. Travel distance is normally limited to 45 m; reaching 90 m requires an accepted additional fire-safety measure. Hydrant location also matters. A minor variance cannot vary Building Code emergency-access requirements.

Tree protection can change the layout or prevent a proposed design. A compliant zoning layout still needs Building Code review and a building permit. The City recommends a Zoning Applicable Law Certificate before the permit application; confirm the current submission requirements with Toronto Building.

## Worked address: 29 Wychwood Avenue, Toronto

Checked in Bucky on 8 October 2026. The address selected parcel 5361021. The City’s public parcel service independently returned the same address, parcel identifier and stated area.

Returned facts and their limits, verified 8 October 2026.

| Fact | Bucky returned | Official check | What it establishes |
| --- | --- | --- | --- |
| Parcel identity and area | 5361021; 162.0568848 m² | [City parcel record 5361021](https://gis.toronto.ca/arcgis/rest/services/cot_geospatial27/FeatureServer/36/query?f=pjson&where=PARCELID%3D5361021&outFields=PARCELID%2CADDRESS_NUMBER%2CLINEAR_NAME_FULL%2CSTATEDAREA&returnGeometry=false) | A matching municipal record, not a survey or title search. |
| Mapped zone label | R (d0.6) | [City zoning map](https://map.toronto.ca/maps/map.jsp?app=ZBL_CONSULT) | The mapped label and returned zone name do not agree. Confirm zoning in the City map before relying on the result. |
| Garden-suite use | Garden Suite listed as a use with conditions; citation 10.10.20.20(1) | [R-zone conditions, including 10.10.20.100(20)](https://www.toronto.ca/zoning/bylaw_amendments/ZBL_NewProvision_Chapter10_10.htm) | The R-zone use requires Section 150.7 compliance. This is not a garden-suite fit assessment. |

## What can I build on this Toronto lot?

This result supports checking a garden-suite design, with zoning confirmation still required. Bucky returned an estimated width of 8.706 m and depth of 20.049 m with medium dimension confidence. These are derived parcel dimensions, not surveyed frontage or rear-yard clearance. Existing-building footprint and floor area were unavailable.

For illustration, if the 20% ancillary-coverage branch applies, 162.0568848 m² × 20% is 32.41 m² shared by all ancillary buildings, including the suite. That calculation does not establish the permitted footprint: setbacks, landscaping, other structures and the main-building coverage overlay must also be checked.

The base-zone envelope is not the garden-suite envelope. This check did not establish lane adjacency, surveyed setbacks, available building separation, protected-tree impacts, emergency access or the existing number of units. Those missing facts prevent a yes-or-no answer for this address.

## Bucky coverage in Toronto

Toronto resolved as live with parcel support on 8 October 2026, and this address returned parcel, zone and cited base-zone facts. Live city coverage does not mean every garden-suite condition is available or verified for every lot. Check the address and the sources before paying for further analysis.

Municipal sources reviewed on 8 October 2026: the office consolidation states city-wide amendments through 30 April 2026, including By-law 849-2025. A later amendment, site-specific exception or applicable former by-law can change the answer. Provincial applicability is summarised from the City’s guidance; confirm the regulation and your proposal with Toronto Building.

## Common questions

### Do I need a laneway for a garden suite in Toronto?

No. A garden suite occupies an ancillary building that does not abut a lane. A laneway suite has separate rules. Emergency access still needs review.

### Does a Toronto address check tell me that I can build a garden suite?

It starts the assessment. You still need to establish the proposed layout, applicable zoning, existing buildings, trees and emergency access. Missing facts are unresolved conditions, not permission to build.

### Can I use the main-house floor space index to size a garden suite?

No. Section 150.7.60.50 excludes garden-suite gross floor area from lot FSI and sets separate floor-area limits. Check the garden-suite provisions and their exceptions.
